When The Meetings Over Terms and Conditions

Whenthemeetingsover.com is a site operated by Whenthemeetingsover.com Ltd ("We"). We provide a service enabling users to network with other individuals and share information over the internet (the Service). We are registered in England and Wales under company number 6644094 and have our registered office at 1, Circus Place, Bath BA1 2PG. We are the data controller for the purpose of the Data Protection Act 1998 (the "Act").

This policy informs you of the terms of use (the Terms) on which you may make use of our website www.Whenthemeetingsover.com (our or the site), and sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. By using our site, you indicate that you accept these Terms. Please do not use our site if you do not agree to these Terms.

1. Access to our Site

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them.

We will use all reasonable endeavours to keep the Service in operation during your subscription. However our obligations will be suspended if and for so long as any circumstances occur which prevent us from delivering the Service including any necessary maintenance updates by us or our website host provider, interruptions to access to the Service or other technical issues.

We aim to update our site regularly and may change the content at any time.

2. Eligibility

Membership to the Service is void where prohibited. Our site is intended solely for users who are eighteen (18) years of age or older. Any registration by, use of or access to the site by anyone under 18, is unauthorised and in breach of these Terms. By using the Service or the site, you warrant that you are 18 or older and that you agree to and to abide by all of the Terms.

3. Subscription to the Service

You can access the Service as a guest or as a member.

To register as a member, you will provide a user name, your email address and password. You shall ensure that your user name and password are kept confidential, and that you do not commit such details to writing, or disclose such details to third parties. This is in the interests of your own security and privacy.

As a member, you have full access to the Service which includes the ability to send messages to other members. We provide the Service to you in consideration of your payment of the charges by Debit or Credit Card. These charges are set out on our pricing page

We reserve the right to increase our charges by giving you 60 days´ notice by email and any such charge increase shall take effect on the day following expiry of the 60 day notice period.

You may elect to terminate your subscription to the Service by giving at least 30 days notice in writing if you no longer wish to subscribe to the Service in the light of any such Charges increase. You will be deemed to have accepted the Charges increase if you do not exercise such right of termination.

4. Use of our site

As a member, you are entitled to upload content such as contact information, likes and dislikes, pictures, images and other information (Content) to the site on your member´s page so that members (and, to a more limited extent, guests) can view the Content. You shall ensure that at all times the Content:

  • Does not contain any personal data (as defined in the Data Protection Act 1998) which includes names, addresses, pictures and car registration plates relating to any living individual;
  • Is accurate, not defamatory of any person, is not in breach of privacy, not obscene, abusive, hateful, threatening, harmful, fraudulent or iflammatory;
  • Does not promote discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
  • Does not infringe the intellectual property rights (such as copyright, trade marks, patents, domain names, database rights, design rights and any other similar rights) of any third party;
  • Is clear that it comes from you and from no-one else.

If the Content does not conform to these Terms, we reserve the right to suspend your access to the Service whether temporarily or permanently and to immediately remove the content which does not comply with these Terms. As a member, you are fully responsible for all use of your account and for any actions that take place using your account. In addition, you agree not to use the Service or the site to:

  • Collect email addresses or other contact information of other users from the Service or the site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
  • Use automated scripts to collect information from or otherwise interact with the Service or the site;
  • Register for a member account on behalf of an individual other than yourself, or register for a member account on behalf of any group or entity;
  • Impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
  • Upload, post, transmit, share or otherwise make available any unauthorised advertising, solicitations or promotional materials;
  • Obtain personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes.

As a guest or a member, you must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.

5. Content Licence

When you post Content to the site, you authorise and direct us to make such copies thereof as we deem necessary to facilitate the posting and storage of the Content on the site. By posting Content to the site, you automatically grant, and you warrant that you have the right to grant, an irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide licence (with the right to sub-license) to us to use, copy, display, reformat, translate and distribute the Content for any purpose, on or in connection with the site or the promotion thereof, and to grant and authorise sublicenses of the foregoing. You may remove your Content from the site at any time. If you choose to remove your Content, the above licence will automatically end, however you acknowledge that we may retain archived copies of your Content.

6. Your data

We are committed to protecting and respecting your privacy.

You choose what information you put onto our site. This information is available and accessible to us as we provide the Service and it is also available to other users of the Service. However, your contact information is not accessible to users who do not subscribe to the Service (guests).

When you register with us, we will record the information that you provide and any use of the Service that you make. We will use this information to personalise the Service we offer to you. We will not make this information available to third parties unless on an anonymous basis. As a member, you can update your details or unsubscribe at anytime on our site.

We may also collect information about how you use our site including the searches that you carry out and information about your computer, including where available your IP address, operating system and browser type, for system administration. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.

All information you provide to us is stored on our secure servers. Although we will do our best to protect your personal data, the transmission of information via the internet is not completely secure and we cannot guarantee the security of your data transmitted to our site and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access and your information will not be transferred outside of the European Economic Area.

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

7. Intellectual Property

All copyright, database rights, trade marks and design rights (Intellectual Property) in the site and in the material published on it (apart from the Content) belongs to us or our licensors. You may download material from the site for the sole purpose of using the site, but you must not copy, transmit, modify, republish, save, pass off or link to any content or material on the site without our prior written consent.

"When the Meetings Over" and all other trade marks and logos on the site are our trade marks. They may not be used or included as part of a third party´s branding or domain name, in connection with any product or service that is likely to cause confusion and may not be copied or used without our prior written consent.

8. Copyright complaints

We respect the intellectual property rights of others and we prohibit members from uploading, posting or otherwise transmitting on our site or service any materials that breach another party´s intellectual property rights. If we receive notification of infringement, we will remove or disable access to the allegedly infringing material and terminate the accounts of repeat infringers. If you believe that any material on the site infringes upon copyright which you own or control, you may send a written notification of such infringement to us at info@whenthemeetingsover.com.

9. Termination

We may suspend access to the Service or terminate your membership, delete your profile and any Content or information that you have posted on the site and/or prohibit you from using or accessing the Service or the site if you breach any of the Terms.

10. Liability and Responsibility

Where the site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

The material displayed on the site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we and third parties connected to us hereby expressly exclude:

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

We will not be liable for any loss or damage caused by any intentional misuse of our site or the distribution of viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site.

Although we provide rules for member conduct and postings, we do not control and are not responsible for what members post, transmit or share on the site and are not responsible for any offensive, inappropriate or otherwise objectionable content you may encounter on the site.

Nothing in these Terms shall operate to exclude or limit our liability for:

  • death or personal injury caused by our negligence or
  • any breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982 or
  • fraud; or
  • any other liability which cannot be excluded or limited under applicable law.
11. General Provisions

You may not assign or transfer any of your rights or obligations under the Terms without our prior written consent. We may assign or transfer our rights under the Terms without consent.

These Terms contain the whole agreement between us and you and supersede any prior written or oral agreement between us in relation to its subject matter.

These Terms and any disputes or claims arising out of or in connection with its subject matter shall be governed by and construed in accordance with the laws of England and Wales and the courts of England have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.
